Terms and Conditions of Use

PESOePADALA.Com provides money remittance and online shopping (the "Services") to you under the following terms and conditions:

WARRANTY AND LIABILITY

The Services are provided on "AS IS" basis and PESOePADALA.com disclaims all warranties or representations of any kind whether express or implied about the features of the Service.

PESOePADALA.Com makes no warranty that the Service will meet your requirements and that the same shall be uninterrupted, secure or error-free.

You understand and agree that PESOePADALA.Com shall not be liable for the following:

1. any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill or any other tangible or intangible losses resulting from the use or inability to use the Service;
2. any unauthorized access to or alteration of information you have provided;
3. statements or conduct of any other party on the Service; or
4. any other matters relating to the Service.

PESOePADALA.com will not be responsible for delay or failure of delivery due to accidents, traffic problems, power failures, floods or other natural disasters. It also reserves the right to refuse delivery in cases of political unrest or natural disasters which in its own absolute judgment may put its partners, officers or employees into some form of danger.

ACCURACY OF INFORMATION

You agree to provide true and accurate information as required in the registration form about yourself and to promptly update the data whenever necessary to keep it true and accurate. If you provide information that is not true or accurate, PESOePADALA.com.com has the right to suspend or terminate your account and/or disallow you from using the Service.

You agree to provide complete and accurate information about the recipient necessary to effect successful delivery of your remittance. PESOePADALA.Com shall not be held accountable for failure of delivery due to erroneous or fictitious recipient information.

FEES, PAYMENT AND CURRENCY EXCHANGE

In consideration for the use of our services, you agree to pay to PESOePADALA.Com a fee for each Money Remittance initiated by you at the applicable rate then in effect and for the cost of items displayed on the website plus the applicable delivery fees. The applicable remittance fee for your transaction will be provided to you prior to your final authorization of the transaction, apart from any applicable fees for additional services.

All payments will be made in the Philippine Peso currency. In addition to the remittance fees applicable to this transaction, a currency exchange rate will be applied. The remitters' currency is converted to Philippine Peso at an exchange rate set by PESOePADALA.Com.

Payment, Remittance fees and the principal amount are due and payable before PESOePADALA.Com processes the transaction. You must pay for the Service by bank (credit or debit) card, direct deposit or internet transfer. If PESOePADALA.Com does not receive authorization from the card issuer, the transaction will be not be processed and funds will not be transmitted to the Recipient. Each time you use the Service, you agree that PESOePADALA.Com is authorized to charge your designated card account for the principal amount, the remittance fee and any other applicable fees. (Your agreement with your card issuer governs use of your card, and you must refer to that agreement to ascertain your rights and liabilities as a cardholder, which may include a "cash advance" fee.)

Likewise, payment done by cheque is subject to banking clearance. We will not act on your order in the event of dishonoured or bounced cheque. To continue processing your order, you are to pay by cash( notes) in replacement of the dishounoured or bounced cheque.

REFUNDS

Refunds of Principal Amount and cancellation of the Money Remittance will be made upon written request of the Sender if payment to the Recipient has not yet been made at the time the request is processed by PESOePADALA.Com. REFUNDS OF FEES will be made upon written request of the Sender if the Money Remittance is not available to the Recipient within the time specified by PESOePADALA.com for the selected service. Refunds will be made within 30 days of receipt of a valid written request from the Sender.

RIGHT TO REFUND

The customer is entitled to a refund of the money to be transmitted as the result of this agreement if PESOePADALA.Com does not forward the money received from you within ten (10) days of the date of its receipt, or does not give instructions committing an equivalent amount of money to your designated recipient within 10 days of the date of the receipt of the funds from you unless you otherwise instruct.

If your instructions as to when the moneys shall be forwarded or transmitted are not complied with and the money has not yet been forwarded or transmitted, you have a right to refund your money.

MODIFICATION/TERMINATION OF SERVICE

We reserve the right at any time to modify, update or discontinue, temporarily or permanently, the Service with or without notice. PESOePADALA.Com shall not be liable to your or to any third party for any modification, suspension or discontinuance of the Service. However, we commit to continue to deliver based on instructions already received at the time of the discontinuance.

You agree that PESOePADALA.Com, in its sole discretion, may terminate your account for any reason, including its belief that you have violated the terms of the Service. You agree that such termination of your access to the Service and/or deletion of your account and all related information and files may be effected without prior notice. You further agree that PESOePADALA.Com shall not be liable to you or to any third party for such termination.

You have the right to terminate your use of the Service, for any reason whatsoever, by sending a notice through e-mail informing PESOePADALA.Com of your intentions. You will receive an e-mail accepting your cancellation except for those transactions which are already in process at the time your notification is received.
